Terms and conditions
In accordance with the relevant legal provisions contained in Peruvian Law, Regulations, its Decrees and other legal provisions applicable in the national territory, the following general conditions and conditions of liability are issued, which will regulate the provision of services, on the one hand between the passenger or user of the services, hereinafter referred to as “THE CLIENT”, on the other hand, the travel agency which shall be referred to as “MACHUPICCHU.CHEAP – TRISTAN UND ISOLDE E.I.R.L.”, and on the other hand, the entities providing the service, such as airlines, hotels, restaurants, carriers, guides and other tourism-related services that are related to this contract, hereinafter referred to as “SUPPLIERS”.
MachuPicchu.Cheap – Tristan und Isolde E.I.R.L., whose line of business is as a travel agency through the subcontracting of independent suppliers, which are not subject to the company’s control, especially in transport services, helicopter flights, hotel accommodation, spas & hot springs, restaurants, cruises, professional guides, car rental, etc. The CLIENTS of MachuPicchu.Cheap – Tristan und Isolde E.I.R.L. have the right to receive truthful and timely information, as it is also the duty of the CLIENT to inform themselves in a responsible manner regarding the rules and conditions of services provided by MachuPicchu.Cheap – Tristan und Isolde E.I.R.L.
These Terms and Conditions shall be deemed known and accepted by the mere fact of explicit acceptance thereof at the time of payment. All acceptance of an offer made shall be subject to the suspensive condition that MachuPicchu.Cheap – Tristan und Isolde E.I.R.L. validates the transaction, after verifying that air and/or land spaces are available and that it validates and accepts the means of payment offered by the user. Consequently, any operation that is carried out, the confirmation, validation or verification by MachuPicchu.Cheap – Tristan und Isolde E.I.R.L., will be a requirement for the completion of the contract.
PURCHASE PROCESS: Our prices include taxes and service charges. Offers subject to stock of 05 seats per destination for flights, hotels, packages, cruises and tours. To make a purchase or contract a service, the process begins with a reservation request generated by the user or consumer from the website or direct attention with our executives and the different promotion channels. The user will receive an email informing them that their request has been received and that their reservation request and the respective payment are being processed after the validation or confirmation process. The purchase confirmation, which depends on the total payment of the service fee and its availability at the time of payment, will be communicated by the same means.
RIGHT OF WITHDRAWAL: For purchases made by electronic or remote means of communication. The mere visit to the website where access to certain services is offered does not impose any obligation on the consumer, unless he/she has unequivocally accepted the conditions offered by the supplier, in the manner indicated in these terms and conditions.
METHODS OF PAYMENT: The services offered can only be paid for using the official legal methods provided by the company in a legal manner in Peru or provided that they have a current contract for such purposes with MachuPicchu.Cheap – Tristan und Isolde E.I.R.L., unless a different method is indicated for particular cases with written authorization from the Representative of MachuPicchu. Cheap – Tristan und Isolde E.I.R.L. may accept payments to different accounts. In this case, the final confirmation will be sent within the following 24 hours to the email address entered by the customer during the purchase process. If you have not received the confirmation within that period, please contact the Executive who is dealing with you or send an email to the corporate email address info@machupicchu.cheap. Interest, taxes, commissions or other charges that may be generated by purchases in installments by credit card depend on the conditions that the client has agreed with each bank or card issuer. We recommend that you find out about the conditions of use and interest of your credit card before using this method of purchase in installments. If the purchaser of the service is not one of the passengers and the purchase is made by credit or debit card, for security reasons, further details will be requested before confirming the purchase. For your security, MachuPicchu.Cheap – Tristan und Isolde E.I.R.L. may limit the maximum number of purchases that a customer can make in a single day. MachuPicchu.Cheap – Tristan und Isolde E.I.R.L. reserves the right to modify any information contained on this website, including information relating to services, prices, availability of spaces and conditions, at any time and without prior notice.
SERVICES: The services offered do not allow changes or refunds from the suppliers. However, any total or partial refund made voluntarily by the supplier(s) for services that have not been used will be given to the client at a later date, minus any penalties imposed by the suppliers. Promotional rates for airline tickets do not allow changes to the ticket, therefore the ticket is non-refundable. Meals as indicated in the itinerary: alcoholic and non-alcoholic beverages are generally NOT included. Tours or excursions, our commitment is to respect as far as possible the visits to the tours mentioned in the descriptions and confirmations. However, there are certain circumstances beyond our control (e.g. place closes to attend to a large distributor, cleaning, inspection, weather conditions, etc.) that may force us to modify the order of the tours to be visited. The programs offered include physical activities, carried out in the open air in contact with nature, as well as excursions and visits at high altitudes, which may involve a risk that will depend on various factors and circumstances over which the organizer has no direct control. Therefore, MachuPicchu.Cheap – Tristan und Isolde E.I.R.L. does not assume responsibility (including monetary) in case of incident (including death) or illness and any other problem that may occur due to acts or omissions of the SUPPLIERS; due to irresponsible acts of the CLIENTS; for reasons of any other nature (for example: poisoning, strikes, storms, etc.) or due to events of force majeure over which there is no direct control.
CANCELLATIONS AND PENALTIES: The penalties for changing dates in economy fares may vary according to the airline and route, and there may also be fare differences to be paid for air tickets/accommodation/tour associated with the required change. There are rates that do not allow date changes or refunds at the discretion of the airline, hotel, tour and transportation company. Modification of Itinerary or Excursions: Any requested modification to your already confirmed trip or experience will incur a surcharge of USD 100, plus any additional costs related to the change.
BOOKING CONDITIONS: The booking of any tourist program must be made for the amount established according to the promotion that is purchased, without prejudice to the modifications that the initial values may undergo due to the conditions of the SUPPLIERS, therefore, the value of the booking amount is non-refundable. The payment of the balance will be explicit in the present contract in the first 2 pages, which will depend on the promotion acquired, which should not normally exceed 30 days after the date of contracting, with some exceptions. If the program is a promotion acquired on credit, this must be paid on the commitment dates agreed with the executive. In the event of late payment due to non-compliance with the established installments, the contract will be canceled.
NOT INCLUDED IN THE TOUR PRICE: Passport costs (if required) for international flights, excess baggage charges; travel insurance; airfares, airport departure and arrival taxes; meals not mentioned in the itinerary; visits to places of interest and activities mentioned as optional; modifications requested after purchase of the trip; personal expenses such as laundry and telephone charges, and anything not mentioned in the section on the price of the program. MachuPicchu.Cheap programs – Tristan und Isolde E.I.R.L. do not include any kind of personal travel insurance. It is highly recommended that the client take out an insurance policy in their country of origin at the time of booking, covering expenses arising from cancellation, accident, illness, repatriation costs, loss of luggage, etc. For elderly passengers, or those with special health conditions, a medical check-up is suggested prior to the start of the trip, to indicate whether or not it is possible to undertake the trip.
CLASSIFICATION OF PASSENGERS: There are three types of passengers: adults, children and infants. The age range for the definition of each will depend on the policy established by each of the services (airline, hotel, excursions, transfers, cruises and other services) and may differ between services. It is necessary to consider the age of minors when leaving and entering the country visited: it is important to check the ages that minors will have during the trip, according to the category defined by ground operators and airlines; this will avoid possible costs due to differences in fares in case there are changes in the categorization of minors during the trip. Minors must be of the age informed by the client at the time of returning from the trip.
DOCUMENTATION: It is the duty of those traveling to find out about the necessary documentation for the trip. Find out in advance if you need a passport, visa, vaccinations or other requirements for both the destination and the countries where your flight makes a stopover. All passengers (adults, children and infants) must keep the documents necessary for the trip valid throughout the duration of the trip (round trip), in perfect condition and with more than six months before expiration: 1) Identity Card, 2) Passport, for countries that require it. 3) Visa in cases where it is required, for countries in transit and countries of destination. It is the passenger’s responsibility to consult the respective embassy or consulate, either of the transit country or of the destination country, about the special entry requirements and conditions at the time scheduled for the trip. Passengers must remain a maximum of 90 days at the destination visited. Only those who have a work or study visa may extend their stay. MachuPicchu.Cheap – Tristan und Isolde E.I.R.L. is not responsible for the loss of any of the required documents or the omission by the CLIENT of any of the requirements indicated above. Passenger information may be stored in our database. Remember that the passenger’s name on the airline ticket must match the first name on their travel document. If this condition is not met, the airlines reserve the right to deny boarding to that person. MachuPicchu.Cheap – Tristan und Isolde E.I.R.L. has the right to photograph, film or record any tour or part thereof and to use the resulting photographs, videos or films for promotional purposes, for which it will be understood that the CLIENT gives his/her authorization, unless the client expresses his/her disagreement at the time of contracting services.
TRAVEL WITH MINORS: 1) Notarized or court authorization to leave the country if traveling with only one parent or a third party (in addition, notarized authorization for the third party to represent the minor before public or private organizations abroad). 2) Death certificate in case one of the parents is deceased and the minors are traveling with the other. 3) Birth certificate. 4) Family record book. All the documents indicated in original and three photocopies. The same applies for national trips including Rapa Nui. UNACCOMPANIED MINOR SERVICE.- this service is not sold on MachuPicchu.Cheap – Tristan und Isolde E.I.R.L.
SPECIAL NEEDS: These services are not sold on the MachuPicchu.Cheap – Tristan und Isolde E.I.R.L. website. However, passengers with special needs must purchase their air ticket from MachuPicchu.Cheap – Tristan und Isolde E.I.R.L. Executives. Services are requested directly from the airline and often involve additional costs. MachuPicchu.Cheap – Tristan und Isolde E.I.R.L. is not responsible for the malpractice of third parties when providing assistance or logistical support. Any special needs should be requested in a timely manner from the Executive at the beginning of the contracting process.
MINIMUM TIME OF PRESENTATION AT THE AIRPORT: 3 hours before departure for domestic flights. 5 hours before departure for international flights. In high season and for connecting flights, the times of presentation at the airport may increase due to demand and terminal changes, so it is recommended to present yourself at the airport 3 hours before for domestic flights and 5 hours before for international flights.
BAGGAGE: Find out about the conditions and the number of kilos allowed for hold baggage and hand luggage for each airline. MachuPicchu.Cheap – Tristan und Isolde E.I.R.L. is not responsible for the deterioration and/or loss and/or theft and/or robbery and/or loss of luggage and other personal belongings of passengers, whether for services contracted through the intermediary of the company or taken individually by the passenger. We recommend that you take out travel insurance to cover some of the aforementioned risks. The baggage allowance included with airline tickets is that offered at the promotional value of the programs, you should check the baggage allowance included with your promotion.
TAXES AND CODESHARES: In some cases, due to strategic alliances, airlines may fly routes in collaboration with other airlines, which could mean not boarding the airline with which the initial ticket was issued. Check your ticket to see which airline is operating each leg of the journey to avoid possible missed flights. Taxes are additional to the fares published by the airline and are included in the final charge. Governments and/or local airport authorities may impose and collect additional taxes at the airport. There are countries where departure taxes and/or fees can only be paid in local currency and in cash at the airport, therefore MachuPicchu.Cheap – Tristan und Isolde E.I.R.L. does not include them or take responsibility for these additional taxes.
CHANGES AND REFUNDS: Airline tickets/hotels and excursions are non-refundable. They are not refundable, cancelable or endorsable. All possible changes and refunds are subject to the policies of the air, hotel and excursion providers. Any other additional services, if permitted, may be made at no cost as long as permitted, or failing that, you are informed that you may be charged penalties for changes and refunds and even charged a difference in those cases where the purchased rate is no longer available. Additionally, MachuPicchu. Cheap – Tristan und Isolde E.I.R.L. will not be responsible for the non-fulfillment, delay and/or cancellation of the service, as a result of a fortuitous event, including, by way of example, pandemics, civil disturbances or industrial disputes, strikes, acts of government authority, climatic phenomena, security reasons, acts of war and terrorist attacks of any nature, occurring in the countries involved in the contracted ticket. If the program was paid for by credit card or other bank card, the client must continue to pay the agreed installments and if charges have been made, no refunds will be made. When booking a stay at an establishment, you accept its cancellation and no-show policies, as well as any additional hotel restrictions. The general cancellation conditions are available on the establishment’s website and in the purchase process of MachuPicchu.Cheap – Tristan und Isolde E.I.R.L., these are shown at the time of booking. Check the details of each room to see the conditions before making the purchase.
CANCELLATIONS, FLIGHT DELAYS AND DENIED BOARDING: Airlines may unilaterally make cancellations, rescheduling, flight delays and denied boarding without prior notice to the travel agency. These situations are beyond the control and knowledge of MachuPicchu.Cheap – Tristan und Isolde E.I.R.L., which is therefore released from all responsibility for these eventual changes.
DENIAL OF ENTRY TO THE COUNTRY: In consideration of the international mobility requirements established by each country, MachuPicchu.Cheap – Tristan Und Isolde E.I.R.L. is not responsible for denial of entry due to: expired passport, lack of visa, temporary residence permit not in force, among others.
SEAT ALLOCATION: The published fares do not allow seat allocation. If the reservation you are making wants to reserve seats, you must do so directly with the airline or with the support of the MachuPicchu.Cheap – Tristan und Isolde E.I.R.L. Executives, which will incur an additional cost, or you can be randomly assigned seats at no cost when you check in.
CHANGES OF ROUTE: Not permitted by airlines, unless the airline allows it under its policies and conditions.
NAME CHANGE: Not permitted by airlines. If there is a typing error in the name entered by the user or consumer, the airlines may charge a fine for rectification.
MAXIMUM STAY: a maximum of 12 months depending on the type of fare.
STOP OVER: In general, promotional and/or cheap fares do not allow Stop Over (getting off the plane at a stopover between origin and destination, and staying in the city where the flight made the stopover, and then taking the flight to the final destination again). It is advisable to check which fares allow this.
CONDITIONS FOR PURCHASING HOLIDAY PACKAGES, HOTELS, EXCURSIONS AND OTHER SERVICES: At the time of payment, you declare that you are aware of and accept the terms and conditions indicated in the service details, as well as the veracity of the personal data of the individual passengers. The service is fully contracted once payment has been made and the relevant purchase confirmation email has been sent. Some hotels and car rental companies require a valid credit card with a certain available credit limit as a guarantee, in accordance with the policies of each company. MachuPicchu.Cheap – Tristan und Isolde E.I.R.L. is exempt from responsibility for these particular demands of each company providing the service. For the duration of the program, the first day is considered to be the day of departure from the point of origin and the last day is considered to be the day of return from the destination. This applies regardless of the departure or arrival time of the flights. Services referred to as “courtesy” services, such as tours, insurance, breakfasts, snacks, agency management fees and airfares, will not be refundable to passengers, except in the event of an incident attributable to the agency that prevents the normal provision of these services.
NO SHOW: In the event of a no-show by the passenger, a charge will be made in accordance with the cancellation policy established by each supplier.
ACCEPTANCE: THE CLIENT declares to accept the general contracting conditions and said acceptance is rectified by means of any of the following acts: a) Payment for the contracted services in any form before the start of the trip; b) Acceptance upon receipt of this contract via e-mail and leaving a record of the acknowledgment of receipt; c) Through the use of any portion of the contracted services. The hotel check-in and check-out times, together with the tour times, will be provided one week before your trip in the confirmation letter.
